Introduction
Welcome to TinkerTank, operated by Project School PTY LTD. These Terms of Use ("Terms") constitute a legally binding agreement between you and TinkerTank regarding your access to and use of our website, programs, mobile applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Eligibility
TinkerTank programs are thoughtfully developed for learners starting from age 5 and above, providing age-appropriate educational experiences for students of all ages, including young learners and adults. For students under the age of 18, registration and participation must be completed and approved by a parent or legal guardian, who agrees to these Terms on the child's behalf. By enrolling a child, the parent or guardian confirms that they have the authority to provide consent. Adults registering for their own participation must have the legal capacity to enter into this agreement.
2. Accounts
When creating an account, you must provide accurate, complete, and current information at all times. Providing false or outdated information constitutes a breach of these Terms and may result in immediate termination of your account.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Please notify us immediately if you suspect any unauthorized use of your account.
3. Intellectual Property Rights
All content, materials, software, designs, functionality, and intellectual property made available on or through the Service remain the exclusive property of Project School PTY LTD or its licensors. This includes logos, branding, educational content, tools, and technology.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. Any unauthorized use, reproduction, or distribution of materials is strictly prohibited.
4. Trademarks
"TinkerTank" is a registered trademark of Project School PTY LTD. Unauthorized use of the TinkerTank name, logo, or any related branding elements is strictly prohibited. All other trademarks appearing on the Service are the property of their respective owners.
5. Online Educational Services
TinkerTank provides digital and in-person educational services designed to engage learners in STEAM and creative technology fields. You agree to participate in our services respectfully, responsibly, and in accordance with all applicable laws.
6. Automatic Acceptance of Terms
By enrolling in a program or making any purchase from TinkerTank, you acknowledge and accept these Terms of Use. This acceptance is binding and enforceable under Australian law.
7. Prohibited Conduct
You agree not to use the Service for unlawful or harmful purposes. Prohibited activities include but are not limited to:
- Violating any law, regulation, or rights of others
- Uploading malicious code or harmful software
- Attempting to access systems or accounts without authorization
- Impersonating individuals or entities
- Posting offensive, harassing, or misleading content
TinkerTank reserves the right to suspend or terminate access to users engaged in any of the above.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, Project School PTY LTD and its affiliates, employees, or agents shall not be liable for any indirect, incidental, consequential, or punitive damages, including lost profits or data, resulting from your use of or inability to use the Service.
10. Indemnification
You agree to indemnify and hold harmless Project School PTY LTD and its affiliates, staff, and agents from any claims, losses, or liabilities arising out of your use of the Service, violation of these Terms, or infringement of third-party rights.
11. Use of Artificial Intelligence (AI) in Education
TinkerTank uses AI technology to personalize and improve educational experiences. By engaging in our programs, you consent to the responsible use of AI systems for educational assessment, support, and communication. We commit to transparency, fairness, and compliance with best ethical practices in AI.
12. Data Protection & GDPR Compliance

13. Assumption of Risk & Liability Waiver
Participation in TinkerTank programs, including physical or technical activities, involves inherent risks. You agree to voluntarily assume all risks of injury and release TinkerTank and its employees from liability for any incidents that may occur.
14. Photographic & Media Release Authorization (Child)
By registering a child for a program, you consent to Project School PTY LTD capturing and using their image or voice for promotional purposes for a period of up to seven (7) years. This consent is limited to Project School PTY LTD and is non-transferable.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be communicated through our website and take effect upon posting. Continued use of the Service after changes constitutes your acceptance of the new Terms.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
17. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and TinkerTank regarding your use of the Service and supersede all prior agreements.
